Terms of Use
These supplemental Terms of Use govern your use of GeoSwitch, including its companion app and Safari extension (the "App"), provided by Didactic Initiatives LLC ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, stop using the App.
Your App Store license is governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms supplement that agreement; they do not replace it with a custom EULA. If these Terms conflict with the Standard EULA or the applicable Apple Media Services terms and Usage Rules, those Apple terms control. Our Privacy Policy explains our data practices; accepting these Terms does not replace any permission or consent required for data collection.
1. License and ownership
The App is licensed, not sold. Subject to Apple's Standard EULA and Usage Rules, you receive a non-transferable license to use the App on Apple-branded devices you own or control, including access by associated accounts where Family Sharing or volume purchasing permits it. We retain ownership of the App and its intellectual property. You may not redistribute, sublicense, or reverse engineer the App except where applicable law, Apple's Usage Rules, or an applicable open-source license permits it.
2. What GeoSwitch changes
GeoSwitch lets you select coordinates or simulate movement that supported Safari web pages receive through the browser's geolocation interface. It does not change your device's actual GPS location, native apps' location, IP address, Apple Account region, or location inferred from other signals.
GeoSwitch does not guarantee anonymity, concealment of your real location, or acceptance of a chosen location by any website. Websites may use your IP address, account information, earlier location readings, or other signals. If the extension is disabled, lacks permission, fails to run, or is incompatible with a page, the browser may return your real location when permitted. Test the result before relying on it.
Route simulation creates a virtual path. It is not navigation guidance or a record of actual travel. Do not rely on the App for emergencies, personal safety, medical decisions, vehicle operation, or any situation where an incorrect or unavailable location could cause injury or damage.
3. Your responsibilities and acceptable use
You are responsible for the locations you choose, the permissions you grant, and how you use the App. Use it only for lawful purposes and with any authorization your activity requires. In particular, you must not use the App to:
- Commit fraud, impersonate another person, stalk or harass anyone, or infringe another person's rights.
- Misrepresent your physical presence where location is legally or contractually required, including attendance, employment, benefits, financial transactions, or eligibility for regulated services.
- Evade laws, sanctions, legally required location checks, or restrictions you are not authorized to bypass.
- Interfere with services, gain unauthorized access, or violate applicable website, game, carrier, or other third-party agreements.
A website may reject a selected location, restrict access, or suspend an account for location switching. The App does not give you permission to breach that website's rules. You are responsible for checking those rules and for consequences arising from your prohibited use, subject to your non-waivable legal rights.
4. Premium purchases and subscriptions
Premium features and the available purchase options, price, billing period, and any trial or introductory offer appear in the App and Apple's purchase confirmation before you buy. Availability and prices may vary by storefront. Existing lifetime purchases remain subject to their purchase terms; "lifetime" refers to the available life of the App, not a promise that the App or any third-party service will operate forever.
- Apple charges your Apple Account when you confirm a purchase, or as stated in the trial or introductory offer.
- Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends. Apple may charge for renewal within the 24 hours before that period ends.
- A trial converts to the disclosed paid subscription unless you cancel before its stated deadline. An unused trial portion may be forfeited when you purchase a subscription, where applicable.
- Manage or cancel in Settings → your name → Subscriptions, or through Apple's subscription management page. Deleting the App does not cancel a subscription.
- You can use Restore Purchases in the App with the Apple Account used for the purchase. Refund requests go through Apple's refund service, subject to Apple's rules and applicable law.
Cancellation generally stops the next renewal; paid access continues for the remaining billing period unless Apple or applicable law provides otherwise. Any price change is subject to Apple's notice and consent requirements. Nothing here removes statutory cancellation or refund rights.
5. Third-party services and compatibility
Safari, iOS, Apple Maps, the App Store, and websites you visit operate independently of us. Their availability, terms, and privacy practices apply to their services. You must comply with applicable third-party agreements, including your internet or wireless service agreement.
Updates to browsers, operating systems, or websites may change or prevent the App's behavior. We do not promise compatibility with every site, uninterrupted access, accurate maps or search results, or a particular website response. Subject to applicable law and existing purchase rights, we may update or discontinue features. This does not remove remedies you have for paid services under applicable law.
6. Warranties
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LOCATION SWITCHING WILL ALWAYS WORK, THAT YOUR REAL LOCATION WILL REMAIN PRIVATE, OR THAT THE APP WILL BE ERROR-FREE OR SECURE AGAINST EVERY THREAT.
We, not Apple, are responsible for warranties that the law does not allow us to disclaim. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the App's purchase price, if any. To the extent permitted by law, Apple has no further warranty obligation; responsibility for other warranty-related claims, losses, costs, and damages rests with us as the developer.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE APP OR THESE TERMS, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, ACCOUNT RESTRICTIONS, OR LOSSES FROM RELIANCE ON A REPORTED LOCATION, EVEN IF ADVISED THAT SUCH LOSSES COULD OCCUR.
SUBJECT TO APPLE'S STANDARD EULA AND APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID FOR GEOSWITCH AND ITS IN-APP PURCHASES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits apply across legal theories, including contract and negligence, to the extent legally enforceable.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or consumer remedy that cannot lawfully be excluded or limited. Where a limitation is not permitted, the applicable mandatory law controls.
8. Claims caused by prohibited use
To the extent permitted by law, you agree to indemnify Didactic Initiatives LLC and its members, officers, employees, and agents against third-party claims and reasonable defense costs directly caused by your unlawful use of the App, your infringement of another person's rights, or your material breach of these Terms. This does not cover claims caused by our own negligence, wrongdoing, or breach of law, and does not restrict non-waivable consumer rights. We will give you reasonable notice of a claim and an opportunity to participate in its defense; no settlement may impose an admission or obligation on you without your consent.
9. Maintenance, support, and product claims
This agreement is between you and us, not Apple. We are responsible for the App and its content, for any maintenance or support we undertake or the law requires, and for addressing product liability, regulatory, consumer protection, and privacy claims concerning the App. Apple has no obligation to provide maintenance or support for GeoSwitch.
If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, and resolving that claim, subject to applicable law.
10. Apple and legal compliance
Apple and its subsidiaries are third-party beneficiaries of the applicable App license and may enforce the applicable license terms against you as provided in Apple's Standard EULA. Nothing in these supplemental Terms reduces Apple's rights under that agreement.
You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and that you are not on a U.S. government list of prohibited or restricted parties. You must comply with applicable export and sanctions laws.
11. Termination
You can stop using the App at any time. Your license may terminate as provided in Apple's Standard EULA if you violate its terms. After termination, stop using and remove the App. Subscription cancellation remains a separate action through Apple. Provisions concerning ownership, liability, accrued obligations, and dispute resolution continue to the extent they remain applicable.
12. Governing law and your consumer rights
These supplemental Terms are governed by California law, excluding its conflict-of-laws rules. Subject to mandatory consumer protections and any governing law or forum required by Apple's Standard EULA, disputes concerning these supplemental Terms may be brought in the competent state or federal courts in Los Angeles County, California. If the law where you live gives you mandatory protections or the right to bring proceedings locally, those rights remain available. These Terms do not require arbitration or waive statutory consumer rights.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
13. Changes to these Terms
We may update these Terms as the App or applicable requirements change. We will publish the revised version at this URL with a new effective date and provide any additional notice or consent the law requires. Changes apply prospectively and do not reduce rights or remedies already accrued.
